Terms & Conditions – The Artist’s Stop 

Effective Date:  6/30/2025

By booking a session for one-on-one consulting or purchasing a video from Seisa Ito, d/b/a The Artist’s Stop, you (“you” or “Purchaser”) agree to the following terms and conditions (“Terms”). Acceptance of these Terms occurs automatically upon completing a booking or purchase. 

1. Nature of Services

The Artist’s Stop provides personalized, experience-based support for artists, including but not limited to:

  • One-on-one sessions for artistic guidance, feedback, and advice.

  • Video content consisting of tutorials, lessons, or shared experiences related to art.

These services are informational in nature and are based on the personal experience of the owner of the Artist’s Stop. They are not a substitute for professional legal, medical, or mental health services.

2. Obligations of The Artists’ Stop

The Artist’s Stop will provide the services as described at the time of booking or purchase. Sessions will be delivered as scheduled (or rescheduled within agreed timelines), and videos will be made accessible via the platform or through a private link. The Artist’s Stop shall provide services in a professional and industry like manner, based on the experience and knowledge shared in its materials and sessions.

Video content will be accessible to the purchaser for personal use. Access may be revoked if these Terms are violated or breached by Purchaser.

3. Booking & Payment

Full payment by Purchaser is required before any session takes place or video access is provided. Sessions are not confirmed until payment is received. All sales are final and no refunds will be issued for cancellations, missed appointments, or dissatisfaction of Purchaser.

4. Cancellation & Rescheduling

You may reschedule a session with at least 48 hours’ advance notice to The Artist’s Stop by email or otherwise in writing. Rescheduling requests made less than 48 hours before the scheduled time are not guaranteed and may result in forfeiture of the session without refund.

5. Missed Sessions

If Purchaser misses a scheduled session without prior notice, the session is considered forfeited, and no refund will be issued.

6. Video Content Access

All video purchases are for personal, non-commercial viewing only. Downloading, recording, sharing, or redistributing video content without explicit permission is strictly prohibited. Access is granted via email or private link after payment and may require an account login. Video content is provided "as-is" based on personal experience. The Artist’s Stop reserves the right to update or remove videos as needed, and no specific duration of access is guaranteed. Notwithstanding, if video content is removed in cases where Purchaser had less than 72 hour access to such removed video, the Artist’ Stop will provide access to other video content similar to the removed content. If such Purchaser is not satisfied with the replacement video content, Purchaser shall be entitled to a refund.

Intellectual Property Rights

All intellectual property, including but not limited to content, materials, presentations, and any other resources provided during the sessions ("Materials"), are, and shall remain, the exclusive property of The Artist’s Stop and are protected by copyright and all other applicable intellectual property laws. By participating in the session and accepting Materials, you are granted a limited, non-transferable, non-exclusive license to use the Materials solely for personal, non-commercial purposes, to grow professionally and advance your artistic career This license does not grant you any rights to modify, distribute, sublicense, sell, or otherwise use the Materials for commercial purposes. All rights not expressly granted to you are reserved by The Artist’s Stop. You may not reproduce, share, distribute, or make derivative works of the Materials without prior written consent from the Artist’s Stop.

7. Time Zone Reminder

All session times are scheduled in U.S. Eastern Time. If you are located in a different time zone, it is your responsibility to confirm the correct local time before booking.

8. Technical Issues

The Artist’s Stop is not responsible for any internet connectivity or technical issues your side. Missed sessions or access issues caused by Purchaser-side problems will not qualify for rescheduling or refunds. If a technical issue occurs on the Artist’s Stop’s end during a session, Artist’s Stop will make every effort to resolve it in real-time. If the issue prevents the session from continuing, The Artist’s Stop will follow up to offer rescheduling or an appropriate solution. If there are issues with receiving or accessing a purchased video, please contact The Artist’s Stop within 24 hours of purchase for assistance.

 

9. Respectful Use

All sessions and materials are shared in a spirit of honesty, respect, and confidentiality. Any harassment, disruptive behavior, or misuse of services will result in immediate cancellation of services without refund.

10. Referral Introductions

The Artist’s Stop may offer referrals to third parties. However, The Artist’s Stop does not control the availability, rates, or services of referred parties. Any ongoing arrangements with referred parties are solely the responsibility of the Purchaser.

11. Privacy & Confidentiality

The Artist’s Stop values your privacy. Any personal or identifying information shared during sessions or communications will be kept confidential and will not be shared with third parties unless required by law or with your express consent.

12. Limitation of Liability

The Artist’s Stop liability to Purchaser is limited to the amount paid for the session or video content in question. The Artist’s Stop is not liable for any outcomes or actions taken based on the services or materials provided.

To the fullest extent permitted by law, The Artist’s Stop excludes any liability for consequential, incidental, indirect, special, or punitive damages (including, but not limited to, loss of profits, data, or goodwill), regardless of the theory of liability (contract, tort, or otherwise), even if The Artist’s Stop has been advised of the possibility of such damages.

The Artist’s Stop does not warrant that services or video content will meet your specific requirements or that the website, services, or videos will be uninterrupted or error-free.

13. In-Person Meetings and Liability

Sessions may take place in public or informal settings, such as cafés or co-working spaces. By agreeing to meet in person, Purchaser acknowledges and accepts any associated risks. Except for gross negligence, the Artist’s Stop is not responsible for any injury, loss, theft, or other incidents occurring before, during, or after the meeting.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflicts of law principles. Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York. By accepting these Terms, you consent to the jurisdiction and venue of such courts.

15. Modification of Terms

The Artist’s Stop reserves the right to update or modify these Terms at any time, with or without notice. Any changes will be effective immediately upon posting on The Artist’s Stop’s website under the Terms & Conditions page, and your continued use of the services or purchase of content will constitute your acceptance of the revised terms. It is your responsibility to review these Terms periodically to stay informed of any updates. If you do not agree with any modifications, you should cease using the services and notify The Artist’s Stop to discontinue your access.

16. Force Majeure

The Artist’s Stop is not liable for delays or failure to perform due to causes beyond its reasonable control, including but not limited to acts of nature, strikes, or government actions.
